By accessing or using our Website and placing an order, you ("Customer," "Buyer," or "you") agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy.

1.2. Scope: These Terms apply to all sales of Products made through the TRUCKY.SHOP Website to customers located in Romania and other European Union (EU) member states.

1.4. Applicable Law and Jurisdiction:

For sales to customers within Romania, these Terms and any disputes arising therefrom shall be governed by and construed in accordance with Romanian law.
For sales to customers in other EU member states, these Terms and any disputes shall generally be governed by Romanian law. However, mandatory consumer protection laws of the customer's country of residence shall also apply where applicable.
Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Romania, without prejudice to the customer's right to bring proceedings in the courts of their country of residence if permitted by EU law.

2. Product Information and Availability

2.1. Product Descriptions: We strive to provide accurate and detailed descriptions of all Products on our Website, including specifications, compatibility (e.g., vehicle make, model, year, engine type), and part numbers. While we make every effort to ensure accuracy, minor variations in color, packaging, or design that do not affect functionality may occur.

2.2. Pricing: All prices displayed on the Website are in [RON for Romania / EUR for other EU countries - specify currency based on your display logic, or indicate both] and include Value Added Tax (VAT) where applicable. Prices do not include shipping costs, which will be added to your order total at checkout. Any additional charges, such as payment processing fees, will be clearly indicated. We reserve the right to change prices at any time, but the price applicable at the time of your order confirmation will be honored.

2.3. Availability: Product availability is indicated on the Website. While we endeavor to keep this information accurate, stock levels can change rapidly. If a Product you have ordered is out of stock or becomes unavailable after you place your order, we will notify you promptly and offer alternatives, a delayed delivery, or a full refund for the unavailable item.

3. Order Process and Contract Formation

3.1. Order Placement: To place an order, you must select the desired Products, add them to your shopping cart, and follow the checkout process on the Website. You will be required to provide accurate and complete information, including your shipping address and payment details.

3.2. Order Confirmation: After placing an order, you will receive an automatic email acknowledging receipt of your order. This email does not constitute acceptance of your order.

3.3. Contract Formation: A binding contract between you and TRUCKY.SHOP for the purchase of the Products is formed only when we send you a separate email confirming the shipment of your order, or a specific order acceptance confirmation if applicable. We reserve the right to refuse or cancel an order for any reason, including but not limited to product unavailability, errors in pricing or product description, or suspicion of fraudulent activity.

4. Payment Terms

5. Shipping and Delivery

5.1. Delivery Areas: We ship Products to addresses within Romania and other European Union member states.

5.2. Shipping Costs: Shipping costs vary based on the destination, the weight and dimensions of the Products, and the chosen delivery method. The exact shipping cost will be calculated and displayed at checkout before you finalize your order.

These are estimated delivery times and are not guaranteed. Delays may occur due to unforeseen circumstances, including but not limited to carrier issues, customs procedures (for non-EU customers, though not typically within EU), or force majeure events. We will endeavor to keep you informed of any significant delays.

5.4. Risk of Loss: The risk of loss or damage to the Products passes to you upon delivery of the Products to the shipping carrier.

5.5. Receipt of Goods: Upon receipt of your order, please inspect the package for any signs of damage before accepting delivery. If the package appears damaged, you should note this with the carrier or refuse delivery. Please inform us immediately if you receive damaged goods.

6. Returns, Refunds, and Warranty

6.1. Right of Withdrawal (Applicable to Consumers in EU & Romania - B2C Sales):

14-Day Right: As a consumer, you have the right to withdraw from this contract within 14 calendar days without giving any reason.
Withdrawal Period: The withdrawal period will expire after 14 days from the day on which you acquire physical possession of the last good in your order.
Exercising the Right: To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by a clear statement (e.g., a letter sent by post or e-mail) to the contact details provided in Section 1.3. You may use the model withdrawal form provided in Annex A, but it is not obligatory.
Effects of Withdrawal: If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of standard delivery (if any), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
Returning Goods: You shall send back the goods or hand them over to us or to [Name/Address of person authorized to receive the goods, if different from main address], without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
Cost of Return: You will bear the direct cost of returning the goods.
Diminished Value: You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. Products must be returned in their original condition and packaging where possible.
Exceptions: The right of withdrawal does not apply to:
- Goods made to the consumer's specifications or clearly personalized.
- Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
- Digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and their acknowledgment that they thereby lose their right of withdrawal.

6.2. Returns for Business Customers (B2B Sales): For purchases made by businesses, the right of withdrawal as described in Section 6.1 does not apply. Returns for business orders are at the sole discretion of TRUCKY.SHOP and may be subject to restocking fees. Please contact us to discuss specific return requests.

6.3. Legal Guarantee of Conformity (Applicable to Consumers in EU & Romania):

Duration: Products sold to consumers are covered by a legal guarantee of conformity for a period of two (2) years from the date of delivery.
Rights: If a Product is found to be non-conforming or defective within this period, you have the right to request, free of charge, the repair or replacement of the Product. If repair or replacement is not possible or disproportionate, you may be entitled to a price reduction or termination of the contract and a refund.
Procedure: To make a claim under the legal guarantee, please contact us with details of the defect. We may require you to return the Product for inspection.

6.4. Manufacturer's Warranty: Some Products may come with a separate manufacturer's warranty, details of which will be provided with the Product or available on the manufacturer's website. This warranty is independent of and does not affect your legal rights under Section 6.3.

7.1. All content on the TRUCKY.SHOP Website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of TRUCKY.SHOP or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

7.2. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website or its content without our express written consent.

Limitation of Liability: To the maximum extent permitted by applicable law, TRUCKY.SHOP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Website or Products; (b) any conduct or content of any third party on the Website; (c) any content obtained from the Website; and (d) unauthorized access, use or alteration of your transmissions or content. Our total aggregate liability for any claims arising out of or related to these Terms or the Products shall not exceed the amount you paid for the Products giving rise to such liability. Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable law.

9.2. Product Use and Installation: You are solely responsible for ensuring that the Products purchased are suitable for your vehicle and are installed correctly and safely. We strongly recommend that all auto parts be installed by qualified and certified professionals. TRUCKY.SHOP disclaims all liability for any damage, injury, or loss arising from improper installation, misuse, or application of the Products.

9.3. Force Majeure: TRUCKY.SHOP shall not be liable for any failure or delay in performance under these Terms if such failure or delay is due to circumstances beyond our reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

12.1. Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions, which shall remain in full force and effect.

12.2. Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TRUCKY.SHOP regarding your use of the Website and the purchase of Products, superseding any prior agreements or understandings.
